Urban Agriculture - Fargo

Home Garden - Home gardens are allowed, however, there may be covenants administered by homeowner’s associations (HOAs) that apply depending on where your residence is located. To check if your house is part of an HOA, contact Cass County Recorder, as it should be on your house’s deed. 

Prior to digging contact North Dakota One Call @ 811 or visit their website to locate utilities. Anyone that will be excavating in the state of ND is required to call the One Call center a minimum of 2 business days before excavation. Residents are reminded to keep in mind property lines and easements as they plan their garden.

Apartment Garden - Check directly with your landlord or property management company if this is allowed, where it is allowed, and what rules apply. 

Backyard Bees - Backyard beekeeping is not specifically addressed, but has been determined to be allowed for personal use.

Backyard Chickens - Up to six chickens are allowed with a yearly permit and other conditions. See the City of Fargo webpage on backyard chickens for the regulations and license. 

Boulevard Garden - Permitted through a temporary ordinance approved by the City Commission on May 18th, 2020, allowing boulevard gardens through September 30th, 2020. Application and permit is required. See the City of Fargo website for the application and more details.

Compost Food Waste - Not addressed by any existing ordinances; the Solid Waste Department sells Earth Machine composters to residents. Check the City of Fargo website for more details.

Pollinator Garden or Natural Lawn - Pollinator gardens and native plantings are permitted as long as the area planted is less than 30% of the property. If planning to cover over 30% of the property area, a Land Management Permit is required, contact the Fargo Forestry Department for additional information at 701-241-1465.

Structures (Raised-beds, rain barrels, and temporary or permanent greenhouses) - Allowed as an accessory use. Structures up to a 10 ft x 12 ft, either temporary or permanent, do not require a permit. Structures more than 120 sq ft require a permit. Keep in mind property line setbacks and easements. There may also be a maximum amount of property that accessory structures can cover.
